Terms and Conditions of Sale

Article 1 – Scope

These General Terms and Conditions of Sale (GTC) define the rights and obligations of the parties in the context of the online sale of products offered by the company. The GTC govern the contractual relationship between the company and the Customer, and are the only ones applicable between the parties. They can be accessed at any time on the website romanticallygifts.com. The GTC are systematically communicated to any Customer who requests them. The Customer declares to have read all of these GTC and, where applicable, the special conditions of sale related to a product or service, and to have accepted them without restriction or reservation before placing an order. The validation of the order by the Customer therefore constitutes acceptance of the GTC in force on the day of the order.

Article 2 – The company

The seller of the products is the company, a legal entity governed by private law.

Article 3 – Products

The products offered for sale are those described on the website romanticallygifts.com, within the limit of available stocks. The company strives to ensure that the photographic representations of the products are as faithful as possible. However, the colors and details of the products may vary depending on the computer screens and browsers used by the Customer. The company cannot be held responsible for such variations. The products comply with the requirements of French law in force. The company reserves the right to modify the assortment of products at any time.

Article 4 – Prices

The prices of the products are indicated in Euros, all taxes included. The company reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of the registration of the order. The prices do not include the delivery costs which are invoiced in addition, and which are indicated before the validation of the order by the Customer. The total amount due by the Customer is indicated on the order confirmation page.

Article 5 – Order

The Customer places his order online from the online catalog and using the electronic form on the website romanticallygifts.com. To be validated, the order must be confirmed by the Customer after finalization of the shopping cart. The Customer must then accept these GTC, choose the delivery address and the payment method, and finally validate the payment. A confirmation email summarizing the order (products, prices, quantity, etc.) will be sent to the Customer by the company. The company reserves the right to refuse any order for legitimate reasons, in particular in the event of an existing dispute with the Customer, total or partial non-payment of a previous order, or suspected fraud.

Article 6 – Payment

The price is payable in full by credit card on the day of the order. The Customer guarantees that he is fully authorized to use the payment method used. The transaction is carried out in a secure environment. In the event of refusal of authorization of payment by the accredited banking organizations, the order will be automatically cancelled.

Article 7 – Delivery

Delivery is made to the address indicated by the Customer during the ordering process. The delivery times indicated are for information purposes only; failure to comply with them may not give rise to any damages. The company cannot be held responsible for the consequences due to a delay in delivery which is not its fault. Upon receipt of the products, the Customer is required to check the condition of the packaging and the conformity of the products delivered. In the event of damaged packaging or missing products, the Customer must make precise and detailed reservations to the carrier upon delivery and immediately inform the company. Risk of loss or damage to the products is transferred to the Customer upon delivery and physical possession of the products.

Article 8 – Right of Withdrawal

In accordance with the legal provisions in force, the Customer has a period of fourteen (14) clear days from the date of receipt of his order to exercise his right of withdrawal, without having to justify reasons or pay a penalty. The products must be returned in their original condition and packaging, intact, suitable for resale. Return costs are the responsibility of the Customer. To exercise this right, the Customer must notify his decision to withdraw by means of an unambiguous written statement. A standard withdrawal form is available on the website. The company will proceed with the refund using the same means of payment as that used for the initial transaction, within fourteen (14) days from the date of recovery of the products or the transmission by the Customer of proof of shipment of the return.

Article 9 – Warranty

The products sold on the website benefit from the legal guarantee of conformity and the guarantee against hidden defects, in accordance with the provisions of the French Consumer Code.

Article 10 – Liability

The company’s liability, in the context of the performance of these GTC, may not be incurred for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of computer viruses. The company cannot be held responsible for any non-performance or poor performance of the contract which would be due either to the fact of the Customer, or to an insurmountable and unforeseeable fact of a third party, or to a case of force majeure.

Article 11 – Intellectual Property

All elements of the website romanticallygifts.com (texts, graphics, logos, images, etc.) are the exclusive intellectual property of the company. Any total or partial reproduction of these elements without the express authorization of the company is prohibited.

Article 12 – Personal Data

The personal data collected from the Customer is necessary for the processing and management of his order. They are processed in compliance with the French Data Protection Act. The Customer has a right of access, rectification, opposition and deletion concerning his personal data. To exercise this right, the Customer can contact the company.

Article 13 – Force Majeure

The company will not be liable for any delay or non-performance resulting from a case of force majeure as usually recognized by French jurisprudence.

Article 14 – Entire Agreement

These GTC express the entire agreement of the parties. They prevail over any other previous or contemporaneous written or oral agreement.

Article 15 – Nullity and Non-Waiver

If one or more stipulations of these GTC are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope. The fact that the company does not avail itself at a given time of any provision of these GTC may not be interpreted as a waiver to avail itself later of any of the said provisions.

Article 16 – Applicable Law and Jurisdiction

These GTC are governed by French law. In the event of a dispute concerning the validity, interpretation or execution of these GTC, the French courts will have exclusive jurisdiction.
